May 9, 1925—THIS DAY IN SCOPES HISTORY
After being arrested by deputy sheriff Perry Swafford (1897-1949), Scopes is formally charged with violating the Butler Act, but is never jailed. Three Rhea County justices of the peace—W.J. Green, Bert Wilbur, and Arch Benson—bind Scopes to a grand jury.
